Terms & Conditions

These Terms and Conditions apply to all quotations, services and deliverables provided by Raygdesign & Drafting Services (ABN 95 772 273 762) (“Raygdesign”, “we”, “us”) to any person or business engaging our services (“the Client”, “you”). By accepting a quotation, issuing a purchase order or instructing us to begin work, you agree to these terms.

1. Quotations

Quotations are based on the information, drawings and scope available to us at the time of quoting. Unless stated otherwise, a quotation is valid for 30 days from its date of issue. Quotations may be given as a fixed price for a defined scope, or as an estimate charged at our hourly rates. Where a quotation is an estimate, the final amount may differ, and we will let you know as early as practicable if the estimate is likely to be exceeded.

2. Scope of Work

Our services are limited to the scope described in the accepted quotation. Anything not expressly included is excluded. Typical exclusions, unless specifically quoted, include engineering certification, site surveys and measurements, 3D scanning, regulatory approvals, and third-party fees.

3. Variations

Changes to the scope, design inputs, standards or program after work has started are variations. Variations, including additional revisions beyond those allowed for in the quotation, will be charged at our current hourly rates or as separately quoted. Where possible we will advise you of the cost impact before proceeding.

4. Client Responsibilities and Information

You are responsible for providing accurate and complete information in a timely manner, including dimensions, specifications, standards, process data, site conditions and any existing drawings or models. We rely on the information you supply and are not responsible for errors, delays or additional costs arising from information that is inaccurate, incomplete or late.

5. Review and Approval of Drawings

All drawings, models and documents should be reviewed and approved by you before they are used for procurement, fabrication, manufacture or construction. Issuing drawings “for construction” or “for fabrication”, or using them for those purposes, confirms your acceptance of the design. We strongly recommend verifying critical dimensions on site before fabrication begins.

6. Engineering Certification

Raygdesign provides design and drafting services. Unless expressly stated in the quotation, our services do not include certification by a Registered Professional Engineer of Queensland (RPEQ) or equivalent. Preliminary engineering calculations prepared by us are intended to support the design and must be checked and signed off by a suitably qualified engineer where required by law, regulation, Australian Standards or the project.

7. Fees, Invoicing and Payment

Unless agreed otherwise in writing:

• We may invoice progressively (for example monthly or at project milestones) or on completion.
• For new clients or larger projects we may require a deposit before work begins.
• Invoices are payable within 14 days of the invoice date.
• All prices are in Australian dollars and exclude GST unless stated.

If payment is overdue, we may suspend work and withhold deliverables until the account is paid. Reasonable costs of recovering overdue amounts may be charged to the Client.

8. Intellectual Property

Ownership of the final deliverables prepared specifically for your project passes to you once all invoices for that work have been paid in full. Until then, all intellectual property remains with Raygdesign. We retain ownership of our pre-existing know-how, methods, templates, standard details and CAD libraries, and may reuse general design knowledge on other projects. Unless you tell us otherwise, we may use non-confidential images of our work in our portfolio.

9. Confidentiality

We treat all information you provide as confidential and will not disclose it to third parties except as required to perform the services (for example, to suppliers you have asked us to engage) or as required by law. We are happy to enter into a separate non-disclosure agreement on request.

10. Program and Delays

We will make every reasonable effort to meet agreed timeframes. Timeframes are estimates and depend on receiving timely information, approvals and payments from you. We are not liable for delays caused by the Client, third parties, or events beyond our reasonable control.

11. Cancellation and Suspension

You may cancel an engagement by giving us written notice. You must pay for all work completed and costs committed up to the date of cancellation. If a project is placed on hold for an extended period, we may charge for the time required to remobilise.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to re-supplying the services or paying the cost of having the services supplied again. We are not liable for any indirect or consequential loss, including loss of profit, loss of production or delay costs. Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law that cannot lawfully be excluded.

13. Privacy

We collect personal information, such as names, email addresses and phone numbers, only to provide our services and to communicate with you. We do not sell or share your personal information with third parties for marketing purposes.

14. Governing Law

These terms are governed by the laws of Queensland, Australia, and both parties submit to the jurisdiction of the courts of Queensland.

15. Changes to These Terms

We may update these terms from time to time. The version published on this website at the time you accept a quotation applies to that engagement.
